Mineral Rights

 

 

Dear Residents,

 

Many of you have emailed asking how you can find out if you own the minerals beneath the surface of your residence.  Others have asked, “How come no one has attempted to sign me up"? Hopefully the following will help shed some light on these questions;

 

·         The Amon Carter Foundation owns one-half of almost all of the minerals in the greater Lake Country area.

·         The Foundation reserved this interest when it sold off portions of the land to various developers since 1970.

·         Exploitation of the Barnett Shale did not begin in earnest until after 2000.

·         Prior to 2000 no one (other than Amon Carter) thought that land in Tarrant County contained any oil or gas so they did not bother to reserve the minerals when they sold the property.

 

Therefore, if you bought your home prior to 2000, you probably own 1/2 of the minerals.

 

The only way to know for sure is to do a title search on your property. Your deed may or may not contain language that would indicate your ownership of the minerals.

 

A title search can be done at the website maintained by Tarrant County (www.tarrantcounty.com)

 

·         Find the section for the County Clerk deed records (Real Property Records) or click here http://ccanthem.co.tarrant.tx.us/

·         Choose Search OPR (Official Public Records) on the left or click here http://ccanthem.co.tarrant.tx.us/search.aspx?cabinet=opr

·         It will be necessary for you to look up each deed in your property's chain of title.

·         You will need to look up in the grantor input box, the name of the person from whom you purchased your property from.

o    If you are uncertain from whom you purchased the property from, you may find it on the Tarrant Appraisal District website (www.tad.org). Choose “Property Data Search” then choose “Search by Location” or click here http://www.tad.org/Datasearch/re_location_search.cfm?matches  and enter you address information for your property.

o    A screen will display your property information.

o    Click prior owners, a box will appear showing previous owners (this list maybe incomplete)

o    Enter the first list owner in the Grantor input box in the OPR search screen.

·         That deed will give you the name of the person who sold the property to the person who sold it to you.

·         This search should be done all the way back until you find the deed, which indicates that Amon Carter Foundation owns 100% of the property.

·         When you look at these deeds, you will need to read them to see if there is any language contained which indicates a reservation of the mineral estate.

·         Not all images have been scanned and are not available online. Note the “Instrument #” and contact the Tarrant County Clerk’s office for further assistance.

 

You can also hire a landman or abstract company to do this title search for you.

 

During my conversation with the representative from XTO Energy, I was told that they intended on leasing the entire neighborhood. This process will take some time, and we ask that you remain patient. We plan to launch a website regarding these gas-leasing matters and will provide information of that web address as soon as is it up and running.
